Ordering and Payment

Your order constitutes an offer to purchase products or services from us. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

  • Product or service unavailability
  • Errors in product or pricing information
  • Errors in your order
  • Suspected fraudulent activity

If we cancel your order after payment has been processed, we will issue a full refund to your original payment method.

Pricing and Payment

All prices are listed in US Dollars (USD) and include applicable taxes. Delivery fees are not included in the product prices and will be calculated and displayed separately during the checkout process.

We accept major credit cards, debit cards, and other payment methods as indicated on our website. By providing your payment information, you represent and warrant that you have the legal right to use the payment method provided.

While we make every effort to ensure that pricing information on our website is accurate, errors may occur. If we discover an error in the price of products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it.

Order Confirmation

After placing an order, you will receive an order confirmation email with your order details. This email confirms that we have received your order, but it does not constitute acceptance of your order. An order is not accepted until we send you a confirmation that the products have been dispatched or are ready for delivery.

Product Information

We make every effort to display the colors and details of our products as accurately as possible. However, the actual colors you see will depend on your monitor, and we cannot guarantee that your display will accurately reflect the color of the product upon delivery.

Due to the nature of our products and seasonal availability of flowers, we reserve the right to make reasonable substitutions to flower arrangements when necessary. Substitutions will be of equal or greater value and similar style to the item ordered. We will make every effort to maintain the general color scheme and style of the arrangement.

Delivery

Delivery Options

We offer various delivery options including same-day delivery (for orders placed before 1:00 PM local recipient time), next-day delivery, scheduled delivery, and standard delivery. Availability of delivery options may vary based on your location and the recipient's location.

Delivery Times

While we make every effort to deliver within the specified time frames, delivery times are not guaranteed. Delivery may be affected by factors outside our control, such as traffic, weather conditions, or accessibility issues. We are not responsible for delays in delivery due to circumstances beyond our control.

Delivery Address

You are responsible for providing an accurate and complete delivery address. If the recipient is not available at the time of delivery, our delivery person may:

  • Leave the order with a neighbor
  • Leave the order in a safe place (if you have specified one)
  • Return the order to our shop for collection or redelivery (additional charges may apply)

For business addresses, if delivery is attempted during normal business hours but the business is closed, we may attempt redelivery the next business day or contact you for alternative arrangements.

Delivery Confirmation

We will send a delivery confirmation email once your order has been delivered. If you have provided the recipient's mobile number, they may receive a text message notification as well.

Product Care

We provide care instructions with all our floral arrangements and plants. To maximize the life and appearance of your purchase, please follow these care instructions carefully. We are not responsible for premature wilting or other issues resulting from improper care after delivery.

Freshness Guarantee

We stand behind the quality of our flowers with our 7-day freshness guarantee (30-day guarantee for plants and terrariums). If you are not satisfied with the quality or freshness of your flowers upon delivery, please contact us within 24 hours with photos of the arrangement. For issues arising within the guarantee period, please contact our customer service team.

Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and data compilations, is the property of Bloom & Petal or our content suppliers and is protected by international copyright laws.

You may not reproduce, distribute, display, or transmit any content on our website for commercial purposes without our prior written consent. Personal and non-commercial use is permitted, provided that you maintain all copyright and other proprietary notices.

User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

User Content

If you submit reviews, comments, or other content to our website, you grant Bloom & Petal a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our website
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our website by any third party

Our total liability to you for any claim arising from or related to these Terms and Conditions or your use of our website shall not exceed the amount paid by you to us during the six-month period preceding such claim.

Indemnification

You agree to indemnify, defend, and hold harmless Bloom & Petal, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms and Conditions or any activity related to your account by you or any other person accessing our website using your account.

Disputes

Any dispute arising from or relating to these Terms and Conditions or your use of our website or services shall be resolved through binding arbitration in accordance with the commercial arbitration rules of Japan. Any such dispute shall be arbitrated on an individual basis and shall not be consolidated with any dispute involving any other person or entity.

The arbitration shall be conducted in Shimane Prefecture, Japan, and judgment on the arbitration award may be entered in any court having jurisdiction thereof. The decision of the arbitrator shall be final and binding on the parties.

Governing Law

These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Japan without regard to its conflict of law principles.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website following the posting of changes constitutes your acceptance of such changes.

Severability
